Contract Offer

This Contract is addressed to any individual, later referred to as "Client." International Drivers Association LLP, later referred to as the โ€œContractorโ€, offers the Client paid services for the registration and issuance of an International Driver's License in PDF format (the โ€œServices").



1. TERMS AND DEFINITIONSย 

1.1 Contractor's Website - website located at https://ida.or.at/ย on the Internet. On the Contractor's Website, Clients are provided with 24-hour and free information about the Contractor and Services, including the information required for the conclusion and execution of this Contract Offer.ย 

1.2. International Driving Permit or IDP - under the Vienna Convention on Road Traffic dated 8 November 1968, a document confirming the right to drive outside the state that issued it. The IDP is an annex to the national driving certificate issued in the Client's state of residence and in accordance with international standards and requirements of the country's residency legislation.ย 

1.3. Order - is an application made by the Client on the Contractor's Website in order to obtain an IDP.


2. GENERAL PROVISIONS

2.1. This offer is in accordance with Art. 395 of The Civil Code of the Republic of Kazakhstan is a public offer agreement (the Contract Offer), full and unconditional acceptance (acceptance) of the terms of which is in accordance with Art. 396 of the Civil Code of the Republic of Kazakhstan is considered to be the implementation of the Order and payment for Services in the manner, amount and terms specified on the Contractor's Website. The acceptance should be complete and unconditional. By taking action on the acceptance of this public Contract Offer, the Client confirms his legal capacity, as well as his legal right to enter into a contractual relationship with the Contractor.

2.2. The Acceptance of the Contract Offer means that the Client agrees with all the provisions of this proposal and is tantamount to the conclusion of the Contract Offer. In connection with the foregoing, read carefully the text of the Contract Offer. If you do not agree with any clause of the Contract Offer, the Contractor suggests you to waive the Contract Offer Acceptance.

2.3. This Contract Offer is available on the Contractor's Website.

2.4. The Contractor has the right to amend the terms of this Contract Offer at any time. Changes in the terms of this Contract Offer take effect when they are published on the Contractor's Website.

2.5. The cost of the Services is announced on the Contractor's Website and is relevant at the time of acceptance.


3. RIGHTS AND OBLIGATIONS OF THE CLIENTย 

3.1. The Client shall be liable for the correctness of the data entered, including for the correspondence of the data entered to its passport data. The Contractor draws up the IDP in accordance with the data provided by the Client.ย 

3.2. The Client undertakes to pay for the Services in the manner, amount and terms specified on the Contractor's Website.ย 

3.3. Due to the fact that according to the requirements of the Vienna Convention On Road Traffic dated 8 November 1968 and the Geneva Convention On Road Traffic dated 19 September 1949, IDPs are issued on paper, the Client realizes that the presence of the IDP is only in PDF format limits the scope of its use by the Client, since, as a rule, state bodies request from drivers the IDP in paper format.


4. RIGHTS AND OBLIGATION OF THE CONTRACTOR

4.1. The personal information provided by the Client is confidential and is not subject to disclosure to third parties, except as required by the law of the RoK.

4.2. The Contractor has the right not to conduct any verification of information, documentation or other information on the assumption that the Client provided the Contractor with accurate and reliable information and documentation. The Contractor may use the information and documentation provided by the Client in good faith to believe that such information and documentation are reliable. The Contractor is not confident about the reliability of the information, documentation and other information provided and is therefore not responsible for their accuracy and reliability.


5. LIABILITY OF THE PARTIES

5.1. Parties are liable under the current legislation of the Republic of Kazakhstan for non-compliance or improper performance under this Contract Offer.

5.2. The client acknowledges and agrees that the Contractor does not provide any assurances and guarantees about the use of IDPs, including, among other things, the adoption of IDPs by government authorities in the Client's host countries, as well as by vehicle rental services.

5.3. The Contractor is not liable for damages caused to the Client or any third party as a result of the use of the IDP or other advice provided by the Contractor during the provision of the Services.

5.4. The International Chamber of Commerce (publication of ICC No. 421 E) is part of the Contract Offer. Parties are exempt from liability for non-compliance or improper performance of obligations under this Contract for the duration of the irresistible force.ย 


6. OTHER CONDITIONS

6.1. Accepting this offer (from the moment of acceptance), the Client expresses to the Contractor his unconditional consent to processing (collection, systemization, accumulation, storage, refinement (update, usage change, distribution), transfer (in that transboundary transfer), depersonalization, blocking, destruction) of their personal data in accordance with the Law of the Republic of Kazakhstan No.94-V of 21 Mayย  2013 "On personal data." The list of personal data for which the Client's consent is processed may include, among other things: surname, first name, middle name; Date of birth Birthplace: The state of birth; Citizenship; Home address; Registration information; Phone number; Email address; Driver's license details; international and internal passport data.ย 

6.2. Accepting this offer (from the moment of acceptance), the Client expresses his unconditional consent to the Contractor to use his own image under article 145 of the Civil Code of the Republic of Kazakhstan.

6.3. The validity, interpretation and implementation of this Contract Offer is governed by the law of the Republic of Kazakhstan.

6.4. All disputes and disagreements arising from the legal relations under this Contract Offer are resolved through negotiations. If it is not possible to resolve disputes during the negotiations, such disputes should be referred to the court of the Republic of Kazakhstan, the city of Almaty, with mandatory compliance with the claim procedure. The response time for a claim is 10 (ten) calendar days from the date of receipt.

6.5. This Contract Offer does not require sealing and/or signing by the Client and the Contractor, while maintaining full legal validity.
